Slaughter and May succeeds for Virgin in the Court of Appeal

Slaughter and May has again successfully represented Virgin Enterprises Limited and Virgin Aviation TM Limited in a dispute with Alaska Airlines Inc. regarding the proper interpretation of a trademark license agreement. In a judgment dated 11 June 2024, the Court of Appeal unanimously rejected an appeal brought by Alaska against a Commercial Court judgment in Virgin’s favour. The Court of Appeal upheld the lower court’s decision that Alaska is obliged to pay the contractually agreed Minimum Royalty each year for the term of the agreement.
