Private enforcement of competition law in the UK

As of October 2015, the private competition law enforcement regime in the UK has been expanded by virtue of the Consumer Rights Act 2015. The Act has broadened the jurisdiction of the Competition Appeal Tribunal (CAT) so that it can hear "standalone" claims (claims that do not follow-on from infringement decisions), and has introduced collective proceedings - the UK’s equivalent of US-style class actions.

This publication provides an overview of the new regime, examines the key differences between litigation in front of the CAT and the High Court, and provides a brief overview of our capability and experience in this area.
