In recent months, there have been a number of important IP developments in Europe. These include a landmark Supreme Court decision which changes the test for patent infringement and the first English case to make a FRAND determination and royalty rate in the context of the licensing of Standard Essential Patents. There have also been Court of Appeal decisions on the registrablity of shape trade marks and not forgetting of course the implications for IP owners resulting from the Brexit vote.
