Current trends in data protection are creating pressures against transferring data out of an individual's home jurisdiction. If allowed to continue, these trends could carve-up markets and erect barriers to free trade. This briefing argues that it is essential that the court, when considering challenges to international data transfer mechanisms, strike an appropriate balance between the imperatives of protecting data and facilitating free trade.
