Corporate directors and de facto directorship - the Supreme Court requires "something more"
1 min read
This article analyses the Supreme Court's guidance on what constitutes a de facto directorship, for which there is no statutory definition, particularly in the context of corporate directorships. It also looks at the court's observations on shadow directorships and how far the courts are able to go in order to protect the interests of creditors.
It broadly reproduces an article that appeared in the April 2011 issue of Corporate Rescue and Insolvency.
