Commission strikes again: third renovation cartel case with repeat offenders

On 3 July 2019, the Hong Kong Competition Commission took to the Competition Tribunal a third renovation cartel case, this time involving two repeat offenders who were found liable for similar conduct by the Competition Tribunal earlier this year. The Commission is seeking for the first time to disqualify a director who is not alleged to have been personally involved in the anti-competitive conduct. This briefing highlights the similarities between the present case and earlier cases and offers some observations on the personal liability of directors as well as the Commission’s continued interest in the building renovation sector.
