In the latest of our Brexit Essentials series of briefings, we consider recently-published changes to the draft Withdrawal Agreement which, if agreed, would mean EU-wide rules on the recognition of jurisdiction agreements ceasing to apply to and in the UK after December 2020. The Hague Convention on Choice of Court Agreements will provide an alternative route for upholding, in the EU27, English exclusive jurisdiction agreements.
