Key changes include allowing claimants to bring actions on an 'opt-out' basis on behalf of entire classes of businesses and consumers, meaning that damages claims may be much bigger in future. These changes go further than recent recommendations made by the European Commission and may therefore see the UK becoming a favoured destination for claimants with a choice where to bring their claims.
