Slaughter and May successfully defends Shell and its directors against threatened derivative claim for a second time

Slaughter and May has again successfully acted for Shell plc and its board of directors in respect of minority shareholder ClientEarth’s application for permission to continue a derivative claim on behalf of Shell plc against its directors. Following a hearing requested by ClientEarth to reconsider the earlier decision to dismiss its application on the papers, the judge confirmed that ClientEarth had failed to show a prima facie case for giving permission to continue its derivative claim.
